FACTS:

The Defendant was accused by his Former Wife of breaking into her home and stealing several items including her laptop computer. The alleged victim claimed that it must have been the Defendant because the home was entered into with the use of keys, his finger prints were in the residence and the victim claimed the Defendant admitted to committing the burglary.

Counsel’s investigation revealed that the alleged victim had a long history of making false allegations against the Former Husband. In addition, the alleged victim was a frequent drug user. Counsel presented facts to the Court and the State Attorney regarding the victims questionable credibility. Counsel also provided factual circumstances that proved that the Defendant could not have been present at the residence at the time the alleged incident occurred.


RESULT: Dismissal on all charges.
